H.S. Phoolka Vs. Jagdish Tytler: Delhi court frames charges against Tytler under defamation law

New Delhi, India: The court of Gaurav Rao, ACMM, Patiala House, New Delhi, today framed charges against Congress leader and Sikh genocide 1984 accused Jagdish Tytler under section 499/500 Indian Penal Code (IPC) for the defamatory statements made by him against senior lawyer and Aam Aadmi Party leader Advocate Harvinder Singh Phoolka during the LIVE telecast of a program titled “Khabro-ki-khabar” and “X-Factor” on NDTV channel.

Ms Kamna Vohra Advocate, appearing on behalf of Mr. H.S. Phoolka argued the case on the basis of evidence on record that charges should be framed against Jagdish Tytler and he should face the trial. Tytler pleaded not guilty to the charges and claimed trial. The Court has now listed the case on 2nd May 2015 for prosecution evidence.

This complaint case was filed by Mr. H.S. Phoolka in the Court of Chief Judicial Magistrate, Ludhiana which had issued warrants against Tytler. Tytler approached Supreme Court for transfer of case claiming that he cannot go to Ludhiana due to threat to his life. The Hon’ble Supreme Court had transferred the case to Delhi.
