Mockers of Baba Fauja Singh to face criminal charges; complaint moved against Indian Hindi Media JaiHindTV

Bathinda (August 04, 2012): Anchor, director, Producer and actor of online TV show, titled JayHind may be facing criminal charges for making mockery of world’s oldest marathon runner and Olympics 2012 torch holder Baba Fauja Singh and victims of serious crimes such as Sikh Genocide 1984.

A complaint under Section 295-A and 500/501 of Indian Penal Code for summoning the accused and trying him for the offences committed by him by producing and airing the Online TV Show in which he has hurt the religious sentiments of the Sikh community as well as defamed the revered Sikh icon Sardar Fauja Singh the great Marathon Runner who created world record at the age of 101 years has been filed before chief Judicial Magistrate of Bathinda.

The complaint is lodged by Amandeep Singh on through his counsel and renowned Human rights lawyer Advocate Navkiran Singh.

“The complainant was deeply hurt when he watched the online TV serial by the name of Jay Hind, which is anchored by Sumeet Raghvan, the accused. The said online TV serial is show cased on their website jayhindtv” states the complaint.

It further adds that in their episode No.229, Segment 4 titled: 100 years old marathon runner, which was till few days available on You Tube and now restricted by the accused only for private viewers was witnessed by a large number of people including Sikhs throughout the World. In the said episode the accused anchored a satire on Sardar Fauja Singh, the 101 years old Marathon Runner who is holding a world record and is a celebrated Hero for the Sikhs and others.

In the said satire the the accused has shown disrespect to the open flowing beard of Sardar Fauja Singh and has been depicted by the accused, by showing the cartoon of Sardar Fauja Singh to be using his white flowing beard for wiping his face like a towel and this action of the accused has hurt the religious feelings of the Sikh community and the accused has attracted criminal prosecution of his under Section 295-A of Indian Penal Code.

The complain further reads that the provisions of Section 295-A of IPC is being reproduced as under for ready reference and in the State of Punjab the same has been amended by extending the imprisonment after conviction from 3 years to 10 years period.

It is notable that section 295-A of IPC penalise the deliberate and malicious acts intended to outrage religious feelings of any class by insulting its religion or religious beliefs.

This provision reads as follows:

“Whoever, with deliberate and malicious intention of outraging the religious feelings of any class of citizens of India, by words, either spoken or written, or by signs or by visible representations or otherwise insults or attempts to insult the religion or the religious beliefs of that class, shall be punished with imprisonment of either description for a term which may extend to three years, or with fine, or with both”.

The complainant has alleged that by showing Sardar Fauja Singh who is revered personality of the Sikhs and a living icon of the Sikhs in such disgraceful manner that he has been depicted to be running to save himself from Jagdish Tytler, i.e. one of the perpetrators of 1984 genocides of the Sikhs which took place in November 1984 and for depicting Sardar Fauja Singh to be a coward and thus showing the Sikhs community in a bad taste he has lowered the image of the Sikh’s in the eyes of general public.

The accused has invited trial and punishment for offence as defined under section 499 of Indian Penal Code and provided with punishment under section 500 of Indian Penal Code, the complainant has claimed in his complaint.

“Criminal complaint filed against JayHindTV at Bhatinda for hurting the religious sentiments of Sikh’s and lowering the image of S. Fauja Singh, the icon/hero of the Sikhs” Advocate Navkiran Singh informed through a post on Social media website Facebook. “Next date is, 1st Sept 2012 for evidence of Amardeep Singh, the complainant” he added.
