New Delhi, India (July 13, 2013): It is learnt that, on July 12, 2013, the Supreme Court of India refused to entertain a petition of Congress leader Jagdish Tytler requesting stay on order of a lower court to re-investigate his alleged role in a November 1984 Sikh massacre related case.
As per media reports a bench led by Justice P. Sathasivam said there was no need for the SCI to interfere in the matter when the Delhi High Court this matter is already pending before the Delhi High Court.
It is notable that Jagdish Tytler’s petition arguing similar grounds is scheduled to for hearing in Delhi High Court on September 18, 2013.
It is learnt that Jagdish Tytler’s counsel sought to withdraw the petition, which the SCI allowed.
It is notable that Jagdish Tytler had moved Supreme Court after the High Court on July 3, 2013 declined to grant interim stay on the trial court’s order for re-investigation.
The trial court had set aside the CBI’s closure report, giving a clean chit to Jagdish Tytler in the 29-year-old case. The order of further investigation had come on a petition moved by kins of victims against CBI giving a clean chit to Tytler and filing the closure report.
It is notable that Jagdish Tytler is considered to be one of the perpetrators of the Sikh Genocide 1984, who instigated the massacre of Sikhs in Delhi. Tytler, just like other perpetrators has enjoyed impunity as no trails or proper investigations have taken place against him during past 29 years. The Indian states has not only protected the perpetrators of the Sikh Genocide 1984, rather they were ‘rewarded’ with powerful political positions.
