SIC Slaps Penalty On PIO Of Punjab Police For Causing Delay In Providing Information

Chandigarh: The State Information Commission during the hearing of a case has held PIO, O/o ADGP (Admn) Punjab Police Headquarters guilty of not providing the information under RTI Act to the appellant in specified time period. The commission has slapped penalty on the PIO of Punjab Police and awarded a sum of Rs.2000 by way of compensation to the appellant.

Disclosing this, an official spokesperson of the State Information Commission said that the award of compensation to the appellant was pronounced by Mr. S.S. Channy, Chief Information Commissioner during the hearing of an appeal in the case of Mr. Shri  Arshdeep Singh Sivia, House no. 2022, Sector 50-C, Chandigarh. (appellant) Vs Public Information Officer O/o IGP Headquarters, Sector-9 Chandigarh and First Appellate Authority, O/o ADGP (Admn) Punjab Police Headquarters, Sector 9, Chandigarh.

During the hearing of the case, the representative of the appellant submitted that the appellant filed his RTI application on 16.05.2016 but the requisite information has not been supplied to him as yet, which is urgently required by him as it has to be produced in a case pending in the Hon’ble Punjab and Haryana Court. He further submitted that the appellant has suffered a lot of hardship in obtaining information in this case.  He requests that a suitable compensation may be awarded to him.

Pronouncing the judgment, the Chief Information Commissioner held that “It is noted with concern that the respondents have sought adjournment of the case a number of times to enable them to supply the information to the appellant but the information has not been supplied to the appellant till date, thus causing undue harassment and embarrassment to the appellant.

Therefore, in view of the loss and detriment suffered by the appellant during this long period, I find full justification in awarding him a suitable compensation. Hence, in exercise of the powers conferred by Section 19(8)(b) of RTI Act, 2005, a compensation of Rs.2000 (Rupees two thousand only) is awarded to Shri   Arshdeep Singh Sivia, Appellant, to be paid by the Public Authority through a Bank Draft.”
