Sonia Gandhi Case – Us Court ruling – Petitioners get time to file amended complaint by December 03

New York, United States (November 20, 2013): US Federal Court in its November 18th order has given “Sikhs for Justice” (SFJ) till December 3rd to file an amended complaint against Congress President Sonia Gandhi in the pending human rights violation case. Despite the opposition from Gandhi’s attorneys, the Federal court granted victims’ request for additional two weeks to amend the complaint about the role of Sonia Gandhi in protecting and shielding the Congress (I) leaders who participated in killing of Sikhs during 1984.

The amended complaint will include the acts of Sonia Gandhi rewarding political positions to those who were involved in the genocidal attacks on the Sikhs. The complaint will also include the recent nomination of Sajjan Kumar’s son as Congress party candidate for legislative assembly from Delhi. Sajjan Kumar is one of the many Congress (I) leaders who led death squads to kill Sikhs after the death of Indira Gandhi.

During Sonia’s medical visit to USA in September, a class action lawsuit was filed by SFJ, a US based human rights group along with victims of November 1984 under Alien Tort Claims Act (ATCA) and Torture Victim Protection Act (TVPA). SFJ and victims are seeking compensatory and punitive damages against Congress party President for her role in shielding and protecting Kamal Nath, Sajjan Kumar, Jagdish Tytler and other Congress party leaders from being prosecuted for their crimes against humanity committed during November 1984.

While, the Sikh rights group claims that Federal Court summons were served on Sonia Gandhi through hospital and security staff at Memorial Sloan-Kettering Cancer Center in New York on September 09, Sonia’s attorneys are challenging the service of summons.

According to attorney Gurpatwant Singh Pannun, legal advisor to SFJ, “twenty nine years of denial of justice and impunity to those who orchestrated genocidal attacks on Sikhs led the victims to file a complaint before a United States Courts”. “the gravity, scale, organized and intentional nature of these genocidal attacks was concealed by the Indian governments by portraying them as “Anti-Sikh Riots of Delhi”. As per official records 37000 claims for deaths and injuries were filed by the victims of November 1984, out of which more than 20,000 claims were by victims who were attacked outside Delhi, added attorney Pannun.
