Supreme Court Of India Halts Compulsory Yoga Education Policy For Schools

New Delhi: As per the media reports the Supreme Court of India here on Tuesday refused to make Yoga education compulsory in schools saying that it was for the Centre to take a call on such issues.

It is learned from the media reports that a bench of Justices Madan B Lokur and Deepak Gupta dismissed a petition filed by an advocate to make Yoga compulsory in schools after Centre opposed the plea.
“We are no body to say what should be taught in schools. It is none of our business. We cannot pass such order, ” the bench reportedly said.
The affidavit filed by the human resource development ministry with SCI purportedly states that “RTE Act does not specifically mention about the curriculum of yoga. As such, it cannot be concluded that yoga education has become an enforceable fundamental right. Yoga is an integral part of the curriculum of ‘Health and Physical Education’, which is a compulsory subject for Classes 1 to 10. To that extent, yoga has not been neglected in school education.”
It seems like the union Human Resource Development ministry pertaining to imposing yoga education has different approach towards school and college curriculum. In July this year All India Council for Technical Education (AICTE) under union HRD ministry through University Grants Commission (UGC) had made taking up yoga as compulsory for the students of engineering colleges and technical institutes of the country or else they may not get their respective degree certificates.
Furthermore, Centre also clarified that education figured in the concurrent list and a majority of schools were under the control of states and Union Territories. Hence, it was for states and UTs to ensure compliance of the provisions of NCF, under which yoga is an integral part of ‘Health and Physical Education’ at all levels of school education, reads the statement published in an English tabloid.
“Implementation of various subject areas, including yoga, depends upon states and UTs concerned,” claims an official. “So far as schools affiliated to Central Board of Secondary Education are concerned, which has adopted NCERT curriculum and syllabi, ‘Health and Physical Education’ is compulsory for Class 1 to 10 and optional at Classes 11 and 12,” reads the claim of center published in Times of India (ToI).
