Punjab Politics: SCI upholds Mohammad Sadiq’s election as MLA

April 30, 2016 | By

New Delhi: The Indian Supreme Court yesterday upheld the election of singer-turned-politician Mohammad Sadique as the Congress MLA. Sadique had defeated ruling Badal Dal’s candidate Darbara Singh Guru from Bhadaur Assembly constituency in Punjab in the January 2012 poll. The seat was reserved for the Scheduled Caste.

A Supreme Court of India bench comprising Justices Ranjan Gogoi and Prafulla C Pant set aside the Punjab and Haryana High Court’s judgment of April 7, 2015. The High Court had held that Mohammad Sadique, being a Muslim, could not have contested from a constituency reserved for SCs.

The Supreme Court pointed out that Sadique had embraced the Sikh religion in 2006, and got this fact published in newspapers.

Prior to this, he had got an SC certificate issued showing him as belonging to the ‘Doom’ community, which came under the SC category.

Badal Dal candidate Darbara Singh Guru had challenged the election of Mohammad Sadique.
