US Federal court dismissed Human rights law suit against Punjab CM Badal on technical grounds

Wisconsin, United States (May 19, 2013): It is learnt that the United States district court of Eastern district of Wisconsin has dismissed the case filed by a New York based human rights body ‘Sikhs for Justice’, Shiromani Akali Dal (Amritsar) led by Simranjeet Singh Mann and others against the Punjab Chief Minister Parkash Singh Badal.

It is notable that the case was filed on August 8, 2012 when the Chief Minister was on visit to Wisconsin, United States. Petitioners had held Badal responsible for overlooking torture and other human rights violations.

According to information, the District Judge Lynn Adelman while pronouncing the judgment on Friday at Milwaukee, Wisconsin ordered to dismiss the petition due to lack of proof of service of summons.

The plaintiff had maintained that they had served summons on Parkash Singh Badal on August 9, 2012 at Oak Creek High School during a function organized by Department of Justice, US Government.

On the contrary the Badal’s counsels had maintained that Badal was never served with summons.

The court reportedly accepted defendant’s pleas and dismissed the case on technical grounds.
