Release of Sikh Political Prisoners: Now Delhi Committee to approach NHRC

New Delhi, India: A written statement by the Delhi Sikh Gurdwara management committee say sthat the DSGMC has decided to again approach India’s National human right commission (NHRC) to evolve a uniform mechanism for premature release of convicts lodged in the jails, especially the Sikh prisoners suffering since the days of armed Sikh struggle for freedom in 1980s-90s. The decision reported came after the Supreme Court of India yesterday (on May 13) gave the liberty to DSGMC to approach the NHRC, subsequent to a petition filed by the gurdwara committee.

A delegation led by DSGMC President Manjit Singh GK would soon approach the NHRC to start a process to evolve the mechanism for premature release of prisoners.Subsequent to the issue of release of Sikh political prisoners of the days of armed Sikh struggle for freedom in late 1980s-90s, raised by Shiromani Akali Dal, and later by other Sikh organizations and Gurbaksh Singh Khalsa who sat on hunger fast on two different occasions for acceptance of the demand, DSGMC has moved NHRC on 5 January 2015 but it refused to hear the matter and the DSGMC filed the petition with Supreme Court. Hearing the petition the Supreme Court had given the liberty to DSGMC to approach NHRC again and incase it failed the Supreme Court would hear the matter.
“Very soon we are taking up the case with NHRC for evolving a mechanism for States and the Central Government so that there is uniform system across the states for release of such prisoners,” said Manjit Singh GK. Welcoming the development, DSGMC general secretary Manjinder Singh Sirsa said that the DSGMC would continue to fight for justice to the Sikhs who are undergoing sentences in different jails of the country who were convicted in cases registered against them during the turmoil.
The advisor of DSGMC’s legal cell Jaswinder Singh Jolly filed the petition before the Supreme Court under article 32 of the Constitution of India seeking intervention for issuing directions to the Central Government, State Governments and the union territories in our country for directing them to coordinate amongst themselves for ensuring formulation of “uniform policies and guidelines” for “regular periodic assessment” and “review of the entire background, current status and present and past conduct of the convicts”, including their conduct during the period the accused were on bail, who have been sentenced with punishment of life imprisonment which would be the basis of their release.
“We have moved a step ahead in release of those prisoners who are suffering due to the days of turmoil of 1990s. DSGMC would take the matter to a logical conclusion,” announced DSGMC president Manjit Singh GK.
