Bhai Jagtar Singh Hawara Discharged in 13 Years Old Moga Case

Moga/Chandigarh: Sikh political prisoner Bhai Jagtar Singh Hawara was finally discharged in a 2005 case today. This case was registered on 18 February, 2005 under FIR 10/2005 registered at police station (PS) Badhni Kalan u/s 307, 323, 183, 353, 120-B (Indian Penal Code) and section 25 of Arms Act.

It is notable that the court of Additional Session Judge Jagdeep Sood had issued production warrants directing the Tihar jail authorities to present Bhai Jagtar Singh Hawara before the court. The court in its order dated May 30, 2018 had directed the police to present Bhai Jagtar Singh Hawara before the court on July 12, 2018.

But during last court hearing on July 12 the jail authorities did not present Bhai Jagtar Singh Hawara before the court citing alleged ‘security reason. The Punjab police had sought time to give a relook to the case but the court did not pass any order in this regard and the case was transferred before the court of Sessions Judge Tarsem Mangla.

Defence counsel Advocate Jaspal Singh Manjhpur told Sikh Siyasat News (SSN) that the sessions court today ordered discharge of this case on merit.

“We had argued before the court that this case does not hold any legal basis and should discharged. Appreciating defence arguments the court discharged Bhai Jagtar Singh Hawara in this case today” he added.
