November 1984 Sikh Massacre: Argument finished in case against Sajjan Kumar, Court reserves verdict

New Delhi, India (April 03, 2013): It is learnt that the arguments in a case against Indian politician Sajjan Kumar for his role in organizing massacre of Sikhs in November 1984 in Delhi, were concluded by the lawyers of all the parties on April 03, 2013 in the court of Session Judge Mr. J.R. Aryan.
The court has reportedly reserved judgment. The Court has asked the lawyers of the parties to appear on April 16, 2013 before the Court to answer if any clarification is needed by the Court.

As per certain media reports on April 16, 2013, the court will fix the date for pronouncement of the judgment.
The lawyers of Sajjan Kumar argued that the government placed the Action Taken Report before the Parliament wherein government rejected recommendation of Nanavati Commission to register case against Sajjan Kumar.
In response to the said submission Mr. H. S. Phoolka, Senior Advocate appearing for the victims argued that if the govt. had been sincere to punish the guilty, then the guilty would have been punished long back. It is not the govt. but the people of this country who want the guilty to be punished. As a result of this when the govt. rejected the recommendations of the Nanavati Commission both the houses of the Parliament did not function for 3 days.
After that on August 10, 2005, the Lok Sabha debated the issue of November 1984 the entire day. The next day on August 10, 2005 Rajya Sabha spent the whole day on the debate on the issue of punishment to the guilty. Ultimately the govt. was forced to change its stand and the Prime Minister gave the statement that as per recommendations of the Nanavati Commission criminal cases would be registered against Sajjan Kumar and Jagdish Tytler.
Mr. Phoolka further argued that though this case pertains to five murders but the Citizens of India, as well as the whole world perceive this as a result to 5000 Murders of Sikhs committed during November 1984. Mr. Phoolka also argued that this Court is not only writing a judgment but it is writing the history of the country.
This case pertains to five murders committed on November 1 and 2, 1984 at Raj Nagar Area, P. S. Delhi Cantt. The case was registered by the CBI in October 2005. The CBI filed Chargesheet in the Court on February 01, 2010. The Delhi High Court appointed Special Public Prosecutor Mr. R.S. Cheema, Senior Advocate by order dated February 10, 2010. The High Court also directed day to day trial.
The charges were framed against Sajjan Kumar Ex-M.P., Mahinder Yadav Ex.MLA, Balwan Khokhar Ex. Councillor, Krishan Khokhar, Capt. Bhagmal and Girdhari Lal in May 2010. The Evidence started on July 01, 2010. 17 witnesses were produced by prosecution and the defense also produced 17 witnesses on behalf of Sajjan Kumar and other accused.
Evidence of both sides concluded in March 2012, Special Public Prosecutor Mr. R.S. Cheema concluded his arguments for prosecution in April 2012 and the defense started arguments in May 2012.
