Prof. Bhullar wife moves Supreme Court of India seeking stay on execution

New Delhi, India (May 07, 2013): It is learnt that Bibi Navneet Kaur, wife of Sikh political prisoner Professor Devender Pal Singh Bhullar – who is facing threats of imminent execution in India, has again moved the Supreme Court of India (SCI) to seek stay on execution of her husband.

Bibi Navneet Kaur has filed reportedly a review petition against the April 12, 2013 decision of the SCI, in which the court had cleared the execution of Prof. Bhullar while setting aside all the arguments and appeals against the death sentenced awarded to Prof. Bhullar in a highly contested manner by the Indian courts.

Bibi Navneet Kuar has reportedly submitted in her plea that she has filed a review petition against the SCI verdict of April 12 in which the court had rejected her petition to commute his death sentence to life imprisonment on ground of delay on the part of the government in deciding his constitutional review petition.

As per a news published by an online news portal named Babushahi (edited by Baljit Balli) the SCI has not passed any stay order on the plea of wife of Prof. Bhullar.

“Senior counsel Ram Jethmalani mentioned the matter before a three-judge bench, headed by CJI Altamas Kabir, but the bench did not pass any stay order”, reads a report (dt. 7 May, 2013) by Babushahi.

Prof. Bhullar was sentenced to death by a TADA special court in 2001 solely on the basis of a fractured confession extracted through torture in police custody.

In 2002 the SCI had confirmed the sentence awarded by the trial court in a split decision, as the presiding judge of three judges bench of SCI had acquitted Prof. Bhullar in his minority judgement.

A constitutional review petition was moved on Prof. Bhullar’s behalf before the President of India in 2003. The President, after a lapse of over eight years, dismissed his this review petition on May 25, 2011.

The Supreme Court of India refused to entertain the inordinate delay in execution as a ground of clemency in Prof. Bhullar’s case. The SCI had cleared his execution on April 12, 2013.

It is notable that in May 2013 the Supreme Court of India commuted the death sentence awarded to another death row convict Mahindra Nath Das entertaining his plea of inordinate delay in execution as a ground of clemency.

Now, Prof. Bhullar faces threat of imminent execution in India.

As India has recently carried executions in secrecy, there are suspicions that the Indian state may attempt to hang Prof. Bhullar in secrecy.
