SDPI disappointed over Gulberg society massacre verdict; Calls it travesty of justice

New Delhi: The Social Democratic Party of India (SDPI) has expressed its dismay and disappointment over the verdict in Gulberg Society, a Muslim residential pocket, massacre case wherein as many as 69 people, including former Congress MP Ehsan Jafri were killed in 2002.

In a written press release (copy available with the Sikh Siyasat News) the SDPI said [i]n fact it is travesty of justice.

It is well known that justice delayed is justice denied and in this case justice was not just delayed but also fractured. Once again it highlights the perennial problem of delayed justice in India, the party said.

SDPI president A. Sayeed said that the present judgment is a clear cut case of delayed justice wherein it took 14 years to decide even though the case was under constant public scrutiny. And in the end it is too little to satisfy the ruffled feathers of the relatives of the victims.

He said that delay in delivering justice to the victims only erodes people’s faith in the judiciary and benefits the criminals who often get benefit of doubt; in so many years, many of the witnesses may die and evidence destroyed. It seems BJP will continue to shield the murderers with brute majoritarianism; and this must be fought politically to ensure justice to the victims.

Sayeed pointed out that the court’s observation on the culprits that “[t]hey are not a menace to society, the accused can be reformed”, gives a provision to the government to commute their sentences. It was the darkest day in the history of civil society. Rarest of rare crimes had been committed with active connivance of the BJP state govt., yet the S.I.T. judge found it prudent to award lighter sentences. It is really a matter of disappointment for all those who expect justice from judiciary.

Sayeed, however appreciated the Special Investigation Team for its attempts of bringing the culprits before the rule of law, which is quiet rare in the independent India.
