New York, United States (September 03, 2013): A US Federal Court has issued summons against Sonia Gandhi, President of Indian National Congress the ruling political party of India, for shielding and protecting the leaders, officials, members and workers of her party who had organized, committed, aided, abetted and incited the genocidal attacks on Sikhs during November 1984.

A class action suit against Sonia Gandhi has been filed by “Sikhs For Justice” (SFJ) a US based human rights group along with victims of November 1984 under Alien Tort Claims Act (ATCA) and Torture Victim Protection Act (TVPA). In the September 3 lawsuit filed before Eastern District of New York (13 CV 4920), SFJ and victims are seeking compensatory and punitive damages against Congress party President for her role in shielding and protecting Kamal Nath, Sajjan Kumar, Jagdish Tytler and other Congress party leaders from being prosecuted for their crimes against humanity.

The 27 page complaint filed against Gandhi to the US Court states that “on August 15, 2013, a group of Congress (I) workers, the party headed and controlled by the Defendant, attacked Tilak Vihar, New Delhi, a colony inhabited by the survivors, mostly widows of November 1984 Sikh Genocide with the intention to harm the witnesses and plaintiffs in order to protect and shield the members, office bearers, leaders and supporters of her party that have played an active role in November 1984 Sikh Genocide. Congress party workers were actively supported by police and many Sikhs sustained injuries in the attack. This recent attack is in continuation of the Genocidal attacks on the Sikh population of India starting from November 1984”.

While demanding a jury trial, the complaint further alleges that “from November 1 through November 4, 1984 approximately 30,000 members of a minority religious group known as the “Sikhs” were intentionally tortured, raped and murdered by groups that were incited, organized, controlled and armed by the ruling political party known as India National Congress Party a/k/a, “Congress (I)”.

According to Attorney Gurpatwant Singh Pannun, legal advisor to SFJ, the lawsuit against Sonia Gandhi under the ATCA and TVPA is motivated by an interest in seeking some form of justice for the victims of November 1984 Sikh Genocide, will raise awareness to the international community regarding denial of justice to the victims and is a mean of holding parties in power accountable for their gross violations of human rights – while also offering the potential to deter future abuses.

Sonia Gandhi’s party which was in power then and now, committed the crime of Genocide against Sikhs as defined in Article 2 of UN Convention on the Prevention and Punishment of the Crime of Genocide. Congress President, by shielding her party leaders and workers from prosecution became culpable under Genocide Convention added attorney Pannun.

Judge Cogan of Eastern District of New York has been assigned the rights violation case against Congress President Sonia Gandhi for her culpability in the genocidal crimes against the Sikh population of India. As per the Federal rules, rights group has 120 days to serve the summons and complaint on Congress (I) President who is currently visiting USA.

Attorney Pannun, who practices international human rights law in NY, states that the conduct of Sonia Gandhi of shielding and protecting the perpetrators of November 1984 Sikh Genocide which was organized, planned and carried out by the members, officials, workers and supporters of her party – Congress (I), gives rise to liability under applicable international and domestic laws, international treaties and federal common law.

Along with the SFJ, the law suit against Congress President has been filed by Mohender Singh from California whose wife survived an attack on August 15 in Delhi and who had lost his father in 1984 and Jasbir Singh, who is prime witness against Tytler’s role in leading death squads during November 1984.

SFJ and victims have filed complaint against Sonia Gandhi on behalf of themselves and other survivors for the severe physical injuries and severe mental and emotional pain and suffering sustained during The Sikh Genocide of 1984.
