Justice Mehtab Singh Gill Panel Recommends Cancellation of FIRs against Bhai Baljit Singh Daduwal

January 29, 2018 | By

Chandigarh: Justice Mehtab Singh Gill Commission has reportedly recommended to the Punjab government to cancel two FIRs registered against Sikh pracharak Bhai Baljit Singh Daduwal.

As per media reports, the commission opined that Bhai Baljit Singh Daduwal did not utter anything “seditious” or “instigate violence” during the November 10, 2015 ‘Panthic gathering’ at village Chabba near Tarn Taran. Bhai Baljit Singh Daduwal was announced as acting Jathedar of Takht Damdama Sahib by the organisers of the gathering.

As per a report in The Tribune (TT), ‘[a]lleging false implication, Bhai Baljit Singh Daduwal had claimed that then Deputy Chief Minister Sukhbir Singh Badal and then Revenue Minister Bikramjit Singh Majithia came to him on November 6, 2015’. Bhai Daduwal reportedly claimed they requested him not to attend the Chabba gathering but when he refused they threatened to implicate him in false cases.

Later, two cases were registered against Daduwal on November 12, 2015, and December 6, 2015. Bhai Daduwal submitted that nothing in both FIRs could be described as seditious.

During the course of hearing, an investigating officer stepped in the witness box to say Bhai Baljit Singh Daduwal did not deliver any speech according to the FIR registered in November 2015. Another police officer said sanction for presenting challan in the court had so far not been received.

“We have gone through the statements of Baljit Singh Daduwal and the investigating officers and also heard the speech delivered by Daduwal, which was provided by him in a pen drive to the commission. Nothing seditious has been said by him nor has he instigated any violence,” Justice Gill asserted.

The High Court had also concluded that nothing seditious was said by the complainant. As challan in both these FIRs had not been presented in court, these be cancelled after taking order from the appropriate court, the panel concluded.

The commission was constituted about nine months back by the Congress party government in Punjab to look into the cases of ‘false implications’ during the 10-year regime of the previous SAD (Badal)-BJP government.
