Sikhs of Canada demand a review & cancellation of Sukhbir Badal’s visa

Ottawa, Canada (August 12, 2013): As per information extended by Moninder Singh Director/Spokesman of Canadian Sikh Coalition (CSC), the CSC earlier had written a letter to Hon’ble Jason Kenney, Minister of Citizenship, Immigration Canada, on the admission of Punjab Police Sub Inspector Surjit Singh, murdering 83 Sikhs in early 1990s at the direct orders of his senior police officers, naming present Police Commissioner Ludhiana Paramjit Singh Gill and an admission of direct link with DGP K.P.S.Gill., in carrying out the “Encounters”, executions in Punjab from 1980-1995.

Sub Inspector last month in July 2013, fearing for his life has requested security from Central Govt. and Punjab Police, for himself and his family, encouraging others to come forward with cases of Human Rights violations under the present Punjab Govt. Based on the evidence presented the Home Minister,Sukhbir Badal, did not initiate any Investigation for the 83 Sikh Youth killed by S.I. Surjit Singh

CSC according to Canadian Immigration laws ENF 18 Section 7,Procedre : Establishing inadmissibility under A35(1)(a):

a) committing an act outside Canada that constitutes an offence referred to in sections 4 to 7 of the Crimes against Humanity and War Crimes Act.

This includes the following:

* persons who commit an offence :persons who attempt to commit an offence; persons who aid and abet, encourage, or are involved in the planning of an offence; persons who are complicit when an offence is committed; a person is considered complicit if, while aware of the commission of atrocities, the person contributes, directly or indirectly, remotely or immediately, to their occurrence. Active or formal membership in the organization responsible for committing the atrocities.

Case law in Canadadian courts has determined that complicity can be found in the following three situations:

*being present at the scene of a war crime, a crime against humanity or genocide; being a member of an organization involved in such crimes ; or being a member of an organization with a limited brutal purpose.

Based on this direct excerpt, the Punjab police are an organization that is responsible for atrocities and committing offences that constitute genocide, where at present the DGP Sumedh Singh Saini, is charged with murder by CBI, Investigation. This recent admission of guilt by Sub Inspector Surjit Singh, now leaves no doubt that the Punjab police should be deemed an organization that is in direct violation with ENF 18″ War crimes and crimes against Humanity”, currently headed by Home Minister and Deputy Chief Minister Sukhbir Singh Badal, and on this basis, members of the Punjab police, should be banned from entering Canada.

Moninder Singh Director/Spokesman of Canadian Sikh Coalition, however did not get a response from the previous Hon’ble Minister Jason Kenney. Sikhs seeking Justice demand a response from Hon’ble Minister Chris Alexander, Minister of Citizenship, Immigration Canada, including but not limited to reviewing the Tourist Visa granted to Sukhbir Badal, DGP.S.S.Saini, Police Commissioner Parmjit Singh Gill and former DGP K.P.S.Gill.

Sikhs of Canada demand a review and cancellation of Sukhbir Badal’s visa on the same section ENF18, where Chief Minister Gujarat Narendra Modi, refusal was administered. South Asian Human Rights, has forwarded the request to Minister Chris Alexander, who has himself witnessed human Rights abuses in Afghanistan, to set an example of enacting a law against Human Rights abuses, in Punjab India. Sikhs in Canada have been targeted by Punjab Police, in respects to their Land wealth in Punjab and to instill fear, with the propaganda of separation, including arrests and torture, under the freedom of expression of political views. Prime Minister Stephen Harper, during his last visit to India, made it clear that Canada values its Sikh Canadians and grants them full rights to freedom of speech, under Canadian Immigration Acts.
