Jagir Kaur going ahead with ‘illegal’ construction despite HC stay: alleges Sukhpal Khaira

Kapurthala, Punjab (August 14, 2014): According to a news reported by YesPunjab.Com, an online news portal, former minister and ex-president of the SGPC Bibi Jagir Kaur is going ahead with construction on a 22 acre prime commercial land of Nagar Panchayat Begowal by violating the interim stay ordered granted by Punjab and Haryana High Court.

Making this serious allegation, Punjab Congress Spokesperson, Sukhpal Singh Khaira has come up with the pictures claimed to have been clicked Thursday August 14.

YesPunjab.com also published photographs released by Sukhpal Khaira in this regard besides supplying the relevant orders of the High Court.

Sukhpal Khaira has also urged chief minister Parkash Singh Badal not to become party to this blatant and flagrant illegal encroachment of this prime Rs 100 Cr govt. property, by convict Bibi Jagir Kaur.

The Congress leader has asked the chief minister to direct DC Kapurthala to immediately stop this land grabbing by MLA Bholath. ”

In case the govt. fails to prevent this violation, we would be left with no option but to move the High Court once again”, he said.

In a press release issued here, Khaira said, Hon’ble High Court of Punjab & Haryana taking cognizance of petition filed by George Shubh, a resident of Begowal, Kapurthala, had issued notice of motion to Punjab Govt. , Bibi Jagir Kaur and others, for illegal encroachment of prime 22 Acres of Nagar Panchayat Begowal Land worth Rs 100 Cr.

Khaira said, “The petition was to come up for hearing on 28.10.14, but Bibi Jagir Kaur a 5 year convict, violating the law started constructing a boundary wall over the said govt. land. Petitioner George Shubh filed an application CM No. 9528-9529 of 2014 in CWP No. 11646 of 2014, seeking a stay on the fresh illegal encroachment initiated by Bibi Jagir Kaur. Justice K Kannan of Punjab & Haryana High Court again taking cognizance on 11.08.14, ordered an Interim Injunction restraining the respondents from putting up any construction and altering the status of the property.

The Congress leader alleged that Bibi Jagir Kaur backed by the CM Mr. Parkash Singh Badal, has once again started construction of the remaining part of the boundary wall, which amounts to clear contempt of court orders and violation of the constitution.

Khaira claimed that when Bibi had started construction after the High Court notice dated 30 May 2014, Khaira had sent a complaint to Director Local Govt. Punjab, who sought a report from the Dy. Director Local Govt. Jalandhar and the EO Nagar Panchayat Begowal.

According to Khaira, “The Dy. Director in his report has categorically admitted and conveyed the fact of illegal construction of approx 1 Km and 6 Ft high boundary wall, constructed over NAC land. He had very clearly stated that the said land belongs to NAC Begowal and that there is no record to show how this land was transferred in the name of Sant Prem Singh Khalsa High School, of which Bibi is the President. Bibi Jagir Kaur is not only grabbing the land to included it within her ‘Dera’, but had also been subletting this land for agricultural purpose to her relatives for the past more than 20 years, misusing its income for personal gains. Money accrued from agricultural income has never been deposited either in the school account or with the NAC Begowal.”

Providing a copy of the notice, Khaira informed that the Executive Officer of Nagar Panchayat Begowal has also issued a notice u/s 195, 195 A of Punjab Municipal Act, 1911 dated 28/06/2014 directing Bibi Jagir Kaur to immediately stop illegal construction over the NAC land but despite this notice. He alleged that Bibi Jagir Kaur has not only constructed the boundary wall but has also developed a small Golf Course on the said NAC land, for the promotion of her grandson’s golfing interests.
